1. Acceptance of Terms

Welcome to PopQuizKenya. By accessing or using our platform at popquizkenya.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and PopQuizKenya. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service following any changes indicates your acceptance of the modified Terms.

2. Eligibility

To use PopQuizKenya, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Reside in a country where participation in skill-based quiz competitions with cash prizes is legal
• Not be prohibited from using the Service under applicable laws

By creating an account, you represent and warrant that you meet all eligibility requirements. PopQuizKenya reserves the right to verify your eligibility at any time and may suspend or terminate accounts that do not meet these requirements.

3. Account Registration

To participate in quizzes and earn prizes, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

Each person may only maintain one account. Creating multiple accounts to circumvent rules, gain unfair advantages, or abuse promotions is strictly prohibited and may result in account termination and forfeiture of winnings.

4. Quiz Rules and Gameplay

Game Format: PopQuizKenya offers timed quiz competitions where players answer multiple-choice questions within a 5-second time limit per question. Questions are organized into stages, with each stage containing 5 questions.

Retry Policy: Players are permitted up to 3 quiz attempts per day. After exhausting all attempts, a 24-hour cooldown period applies. Players may purchase additional attempts to continue playing before the cooldown expires.

Fair Play: All participants must play fairly and honestly. The following activities are prohibited:

• Using automated tools, bots, or scripts
• Exploiting bugs, glitches, or technical vulnerabilities
• Collaborating with others during individual gameplay
• Using external assistance or reference materials
• Attempting to manipulate quiz results or timing mechanisms

5. Prizes and Payouts

Prize Structure: Cash prizes are awarded based on stage completion. Stage 1 awards Ksh 1,000, with each subsequent stage adding Ksh 500 to the prize pool. Prize amounts are subject to change with notice.

Withdrawals: To withdraw winnings, you must provide valid bank account details and complete any required identity verification. Withdrawals are processed within 1-3 business days, subject to verification and fraud prevention checks.

Taxes: You are solely responsible for any taxes applicable to your winnings. PopQuizKenya may be required to report winnings to tax authorities as required by law.

6. Payments and Fees

Certain features may require payment, including additional quiz attempts. All payments are processed securely through our payment partners. By making a payment, you agree to the payment processor's terms of service.

All fees are non-refundable except where required by law or at PopQuizKenya's sole discretion. We reserve the right to change pricing at any time with reasonable notice.

7. Intellectual Property

All content on PopQuizKenya, including but not limited to text, graphics, logos, images, software, and quiz questions, is the property of PopQuizKenya or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our express written permission.

8. User Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Engage in any fraudulent or deceptive practices

9. Account Suspension and Termination

PopQuizKenya reserves the right to suspend, limit, or terminate your account at any time for any reason, including but not limited to:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Failure to verify your identity when requested
• Abuse of the platform or other users

Upon termination, you forfeit any unredeemed prizes or account balances, except where prohibited by law.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

PopQuizKenya is a skill-based quiz platform. Success depends on your knowledge and quick thinking. We make no guarantees about your ability to win prizes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POPQUIZKENYA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you have paid to PopQuizKenya in the twelve (12) months preceding the claim.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.
